@Angel Monroe-Rashé I had a long talk today with a friend of mine who is royally pissed at his release. After a long talk we conclude:

fuck Cosby for being sexual predator

and fuck the government for releasing the guilty and locking up

the innocent

@Angel Monroe-Rashé It was brought up at the trial level, otherwise it would not be available on appeal. It could have been a 5-minute conversation that the judge quickly decided or 100 pages of competing arguments. In most circumstances, once the trial level judge makes a "mistake" the trial still goes on, and everyone still fights like there will be no appeal, because, in the vast majority of cases, even those that are blatantly unfair, the court above does not grant the appeal (right to re-argue something you thought was wrong below), and if we stopped every trial to see if an appeal was granted because one side thought something was unfair, it would quickly get to a point where everyone would think "why bother having a trial judge at all, just let everyone argue in front of the appellate court?"
