The Pennsylvania Supreme Court found that an agreement with a previous prosecutor prevented the actor from being charged in 2015.
Pennsylvania’s highest court overturned Bill Cosby’s sex assault conviction Wednesday after finding an agreement with a previous prosecutor prevented him from being charged in the case.
Cosby has served more than two years of a three- to 10-year sentence at a state prison near Philadelphia. He had vowed to serve all 10 years rather than acknowledge any remorse over the 2004 encounter with accuser Andrea Constand.
I’m halfway through the 79-page Majority opinion, basically there was an agreement with the prosecutor (DA) that there would be no criminal trial, this agreement caused Cosby to be required forego his 5th amendment rights against self-incrimination in the CIVIL case (you can’t claim the 5th about something for which the government has said it will not prosecute you).
Cosby lost in the civil trial.
If you want to be mad at someone, you should simply REMAIN mad at the government’s insistence on trampling people’s rights at the trial level, this kind of behavior has become so common (abuse of constitutional rights) that certain government actors have forgotten the rules they are supposed to at least pretend they are abiding by.
Hence the socio-economic discrepancy in fairness, most of the time only rich people can afford an appeal, everyone else just has to sit back and take it.
this is why i never ever listen when people try to spread the lie that accusations of sexual assault ruin the accused person's life. cosby was CONVICTED of rape in such a high profile case and STILL managed to get off relatively easily.
Wow. I can’t truly believe this.
